1. About this Privacy Policy

WECAN Consulting Limited, trading as Testing Core ("Testing Core", "we", "us" or "our"), operates testingcore.com and our online store and related services. We are a New Zealand business and are responsible for the personal information we collect and hold in connection with our website, online store, products, services and communications.

Testing Core primarily operates on a business-to-business basis. We may collect personal information about individuals who act for or on behalf of our business customers, including directors, owners, purchasing managers, engineers, accounts staff, delivery contacts and other authorised representatives.

This Privacy Policy explains what personal information we collect, how we collect it, why we use it, who we may disclose it to, how we protect and retain it, and the rights available to individuals under the New Zealand Privacy Act 2020.

This Privacy Policy should be read together with our Terms and Conditions and other policies published on testingcore.com. If there is a conflict between this Privacy Policy and our Terms and Conditions concerning the handling of personal information, this Privacy Policy applies to that handling.

2. What is personal information?

Information about a company or other legal entity is not, by itself, personal information. However, information about identifiable individuals associated with a business customer is personal information and is handled under this Privacy Policy.

· Payment and financial information, including payment method, transaction amount, payment status, billing information and limited payment details needed to process and reconcile transactions. Payment card details may be collected and processed directly by our payment providers.

· Communications, including information contained in emails, enquiries, quotation requests, support requests, warranty claims and other communications with us.

· Technical and device information, including IP address, browser type, device information, operating system, network information and other identifiers.

· Website and usage information, including how and when you interact with our website and online store, pages visited and interactions with our Services.

· Information provided by third parties, such as payment providers, delivery providers, business partners, fraud-prevention services and other service providers.

4. How we collect personal information

We may collect personal information:

· directly from you when you contact us, request a quotation, place an order, create an account, complete a form or otherwise provide information;

· automatically through our website and online store, including through cookies and similar technologies;

· from service providers that provide technology, payment, delivery, analytics, fraud-prevention or other services to us; and

· from other persons or organisations where collection is permitted by law and reasonably necessary for our business activities.

Where we collect personal information from a source other than the individual concerned, we take reasonable steps to comply with the requirements of the Privacy Act 2020 concerning the source of personal information.

Providing personal information is voluntary. However, if you do not provide the information we reasonably need, we may be unable to process your quotation, order, delivery or warranty claim, or otherwise provide our Services to you.

We may use personal information for purposes including:

· processing quotations, orders, payments, deliveries, returns and warranty matters;

· providing customer support and communicating with you about our products and services;

· maintaining business and transaction records;

· managing customer accounts and our business relationships;

· Shopify, which hosts and supports our online store;

· payment processors and financial service providers;

· couriers, freight companies, fulfilment providers and logistics providers;

· manufacturers, suppliers or other third parties where reasonably necessary to process an order, delivery, technical enquiry or warranty matter;

· IT, cloud storage, website, analytics, communications, customer-support and other service providers acting on our behalf;

· business and marketing service providers where permitted by law;

· professional advisers, insurers, auditors and other service providers where reasonably necessary;

· government agencies, regulators, courts or law enforcement where required or permitted by law; and

· another entity in connection with a sale, restructuring, merger or other business transaction, subject to applicable law.

We do not sell personal information as a business activity.

9. Relationship with Shopify

Our online store is hosted and operated using Shopify. Shopify may process personal information on our behalf and may also process information independently for purposes described in Shopify's privacy documentation.

Information submitted through our store may be transmitted to Shopify and other service providers, including providers located outside New Zealand.

Where Shopify processes personal information independently for its own purposes, its own privacy terms may apply to that processing.

10. Overseas processing and disclosure

Some of our service providers may be located outside New Zealand or may store or process personal information outside New Zealand. This may include providers used for website hosting, ecommerce, payment processing, analytics, communications, cloud storage, advertising, fulfilment and shipping.

Some overseas service providers may process or store personal information on our behalf. Your personal information may therefore be stored or processed outside New Zealand in connection with the purposes described in this Privacy Policy.

The privacy laws and protections applicable in those jurisdictions may differ from those in New Zealand.

11. Security

We take reasonable steps to protect personal information against loss, unauthorised access, use, modification, disclosure and other misuse, having regard to the nature of the information and the circumstances in which it is held.

No electronic transmission or storage system can be guaranteed to be completely secure. We cannot guarantee absolute security.

You should take reasonable care when sending sensitive information electronically and should not send unnecessary sensitive information through ordinary email.

Website hosting and security incidents. Our website and online store are hosted on the Shopify platform. Shopify provides the underlying hosting, infrastructure and security services for the platform. We take reasonable steps to protect personal information within our control, but no website, platform or method of transmission or storage is completely secure, and we cannot guarantee that the website, or personal information held in connection with it, will be free from unauthorised access, hacking, data breaches or other security incidents. To the maximum extent permitted by law, we are not liable for loss or damage arising from a security incident, unauthorised access or breach affecting the Shopify platform or other third-party providers, or otherwise arising from circumstances beyond our reasonable control. This does not limit our obligations under the Privacy Act 2020, including our obligations relating to reasonable security safeguards and notification of notifiable privacy breaches where required by law.

12. Retention of personal information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected or as otherwise required or permitted by law.

This may include retaining information for customer service, orders and warranty matters, accounting and tax obligations, legal requirements, dispute resolution, fraud prevention, record keeping and enforcement of agreements.

When personal information is no longer required, we take reasonable steps to securely delete, destroy or anonymise it, subject to any legal, technical or operational requirements that require continued retention.

13. Your privacy rights in New Zealand

Under the Privacy Act 2020, individuals generally have the right to request access to personal information we hold about them and to request correction of information that is inaccurate, incomplete, out of date or misleading, subject to the exceptions and procedures in the Act.

You may also contact us if you believe we are not handling your personal information appropriately or if you have another privacy-related request. We may need to verify your identity before responding to a request.

You may ask us to delete personal information where we are not required or otherwise permitted to retain it. We will assess such requests in accordance with applicable law.

Some requests may be declined or limited where the Privacy Act or another law permits or requires us to withhold information.

Please provide enough information for us to identify you and locate the relevant information. We may ask for reasonable evidence of identity.

We will handle requests in accordance with the Privacy Act 2020 and applicable timeframes.

We maintain procedures for responding to suspected privacy breaches. If we become aware of a privacy breach, we will assess the circumstances and take reasonable steps to contain, investigate and remedy the breach.

Where a breach is a notifiable privacy breach under the Privacy Act 2020, we will notify the Privacy Commissioner and affected individuals as required by law.

Our website may contain links to websites or services operated by third parties. We are not responsible for the privacy or security practices of those third parties. You should review the privacy policy of any third-party website you use.

Information you provide directly to a third party is handled according to that third party's privacy practices and terms.

18. Children

Our Services are intended primarily for businesses and adults acting on behalf of businesses. We do not knowingly seek to collect personal information from children for the purpose of providing our Services.

If you believe a child has provided us with personal information, please contact us so that we can assess the circumstances and, where appropriate and legally permitted, delete the information.

19. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our business practices, technology, service providers or legal requirements.
